MAIN TERMS AND CONDITIONS
WE DO NOT CHARGE A BUYERS PREMIUM.
WE DONT BELIEVE YOU SHOULD HAVE TO PAY TO GO TO AN AUCTION.
You must register with CLC Auction Services to bid or buy at any auction conducted by this auction company. To register with CLC and receive a bidder number you will need to provide a valid driver’s license, correct mail address & phone number. You must provide a copy of your resale certificate at every auction you intend to buy for resale. Resale Certificate must be in the name you register under. If buying for farm use you will need to fill out and sign a farm exempt form.
We will accept payment by cash or check with proper identification. Unknown Buyers need a bank letter from your bank guaranteeing that your check will be good. If you do not furnish a bank letter CLC may decide to hold your purchases until the check has been verified to be good or has cleared the bank. All purchases must be paid for on sale day and within one hour after close of sale.
Bank Letter will need to be on the banks stationary with the banks letter head.
Letter will need to read,
“ Banks Name” will guarantee this customers payment by check “Customers Full Name, Account # and Check #” up to “Money Amount” to purchase an item or items at auction on “Date” conducted by CLC Auction Services. The Bank and customer understand that this is an auction and the auction company is not able to give any kind of warranty or guarantee and that it is the customers responsibility to inspect items carefully before bidding and buying. “Print Name of & Signature by Bank” “Address, Phone Number & Date”.
HOT CHECK WRITERS YOUR NAME WILL BE POSTED IN OUR OFFICE AND ON OUR WEBSITE AND ANNOUNCED AT ALL OF OUR AUCTIONS AND WILL BE GIVEN TO OTHER AUCTION COMPANIES. IF YOU GIVE A BAD CHECK YOU WILL BE BARRED FROM ALL OF OUR AUCTIONS. IF YOU TRY TO ATTEND YOU WILL BE CALLED OUT AND TOLD TO LEAVE. YOU WILL BE PROSECUTED TO THE FULLEST EXTENT BY LAW. THERE WILL ALSO BE A $30 HOT CHECK FEE. "MAKE SURE ITS GOOD BEFORE YOU COME TO THE AUCTION".
NON PAYERS IF YOU DO NOT PAY FOR YOUR PURCHASES YOUR NAME WILL BE POSTED IN OUR OFFICE AND ON OUR WEBSITE AND ANNOUNCED AT ALL OF OUR AUCTIONS AND WILL BE GIVEN TO OTHER AUCTION COMPANIES. YOU WILL BE BARRED FROM ALL OF OUR AUCTIONS. IF YOU TRY TO ATTEND YOU WILL BE CALLED OUT AND TOLD TO LEAVE. YOU WILL ALSO BE PROSECUTED TO THE FULLEST EXTENT BY LAW. REMEMBER WHEN YOU ARE THE WINNING BIDDER YOU HAVE ENTERED YOURSELF INTO A CONTRACT THAT IS BINDING BY LAW.
CLC AUCTION SERVICES is a licensed Auction Company and must adhere to all Texas laws regarding the sale of titled items. State law requires all titles to be transferred in the buyers name. CLC guarantees title & year model on vehicles with VIN# only such as (cars, pickups and trucks) unless announced otherwise. CLC does not guarantee year model or title on golf carts, ATV’s, boats, mopeds, scooters, motorcycles, lawn mowers, trailers and items missing or without a VIN#. All titled item purchases will be charged a $15.00 per item title clerk processing fee. All titles can be picked up in 15 banking days. If you pay by check your check may need to clear before title is picked up. When titles are announced Slow Title the seller will have 20 days to deliver title to auction office. After 24 business days the buyer may notify CLC in writing of their choice to be refunded. The vehicle will need to be returned to the Auction Company in the same condition as when buyer purchased the vehicle. CLC urges the buyer not to spend money on a vehicle until the title has been turned over to the buyer. CLC will not be responsible for money spent on vehicle after buyer purchased the vehicle.
Every item is sold as is where is without any warranties or guarantees expressed or implied unless announced otherwise by the auction owner. CLC is not responsible for any mis-descriptions. CLC and its auctioneers are acting as an agent for the seller or consignor only. It is the buyers responsibility to inspect all items of interest and verify the condition of, the quality of and the value of an item before biding at this auction company. No sale is voided for any fault or misdescription.
Once the auctioneer says sold the item he has sold immediately becomes the buyer’s responsibility to keep up with. CLC will not be responsible for any lost, stolen, or damaged merchandise. We encourage you to bring boxes for small item purchases and to take all small items purchases on sale day. All purchases must be paid for before being loaded. Buyer will be required to show paid receipts before loading out.
In case of a tied bid the auctioneer may reopen the bid between the tied party only, however the auctioneers bidder will be favored and the other bidder will have to raise the bid. The seller or the sellers agent reserves the right to bid in order to get the price the seller wants for his or her item except when the auction is advertised as an absolute auction. If you are not able to make the auction you may leave an absentee bid and CLC will bid on your behalf. To leave an absentee bid you may be required to leave a deposit of $20 minimum or up to 10% of your bid.
THE AUCTION COMPANY OR THE SELLER IS NOT RESPONSIBLE FOR ANY ACCIDENTS OR INJURIES. YOU THE PARENTS OR GUARDIANS ARE RESPONSIBLE FOR YOUR CHILDREN AT ALL TIMES. EVERYONE AGREES TO HOLD HARMLESS THE AUCTION COMPANY FOR ANY ACCIDENTS OR INJURIES THAT MAY OCCUR. EVERYONE AGREES TO THE TERMS AND CONDITIONS OF THIS AUCTION COMPANY UPON ENTERING THE PREMISES.
REMOVAL TIMES:
When the auction is conducted at our auction facility you will need to have all purchases removed by the following times given unless other arrangements have been made, Sale day till 6:00pm, Closed on Sunday, Open Monday and Tuesday 9:00am till 5:00pm. A storage fee of $5 a day will be applied if your purchases are not removed by the times given. If your purchases are not removed in 15 days the auction company will dispose of or resale your purchases.
When the auction is being conducted away from our auction facility you will need to have your purchases removed by the following times given unless other arrangements have been made. Sale day till 5:00pm. Closed Sunday, Open Monday 10:30am to 4:00PM. A storage fee of $10 a day will be applied if your purchases are not removed by the times given. If your purchases are not removed in 15 days the auction company will dispose of or resale your purchases.
All bidders, buyers and sellers agree to all terms and conditions of CLC Auction Services upon registering to bid or buy and upon consigning an item to sell at all auctions conducted by this auction company. No Exceptions.
Attention Sellers, At Our Consignment Auctions,
If your item does not sell the first time at auction you may leave it for a second time. If it does not sell the second time there will be a $20 PO fee. If left for a third time the item will be sold absolute without reserve.
All titles must be turned in to the auction office prior to auction day. If title is not turned in your item will not be sold. If title is being held up due to a transfer or lien we must have a copy of the title and must be announced slow title when item sells. Seller has 20 days to turn over a slow title or after 24 days the buyer may be refunded at his choice. Only U.S. titles are accepted. All titled item sales will be charged a $15.00 per item title clerk processing fee. This goes for all individuals and dealers whether you are buying to keep or for resale.
Announcements made sale day supersede all other advertisements and written & verbal agreements.
All bidders, buyers and sellers agree to all terms and conditions of CLC Auction Services upon registering to bid or buy and upon consigning an item to sell at all auctions conducted by this auction company. No Exceptions.
CLC reserves the right to refuse service to anyone.
No carrying of firearms on the auction premises.
